before your first guest books.

Five dots is the best answer for an owner who wants to run the unit themselves. One dot is a red flag. Open “What the documents say” under each for the exact words.

Can you rent it your way?

Typical

Whether the deed and rules let you rent short-term on your own terms: no requirement to use the on-site program, no minimum stay that kills weekend bookings, and no rule against saying where the condo is.

STR is allowed with no minimum stay or program requirement, but owners must register an 'approved rental agent' that complies with an unseen KPMA 'Minimum Rental Agency Arrangements' policy, and no-sign rules apply.

Short-term rentalsAllowed
Must use on-site programNo
Off-site manager allowedYes
Owner-use limitsNone stated. Units limited to residential use; no business on the Project (Master Deed 5.1(a)-(b); Rules 2). KPMA prohibits time-share ownership/lease (KPMA Declaration 3.14).
RegistrationOwner must give written notice to KPMA and West Hyde Park through the Managing Agent of the name and contact information of their 'approved rental agent' (Rules 1); rental agents must comply with a KPMA 'Minimum Rental Agency Arrangements' policy (not in the set) before any rental activity; owner must furnish KPMA the name and address of any lessee (KPMA Declaration 9.10); all leases must be in writing and subject to the Master Deed and Bylaws (Master Deed 5.1(f)). Whether an owner renting personally (no agent) satisfies the rental-agent rule is unstated.
Advertising rulesNo 'For Rent'/'For Sale' or other signs on the exterior of any unit, building, motor vehicle, or landscaped areas, or visible from the exterior (Rules 23; Master Deed 5.1(h); KPMA Declaration 8.8). No restriction on online advertising, resort name or photos stated.

Will your guests be treated like guests?

Typical

Whether a guest who booked through you gets the same resort as a guest who booked through the front desk: the same pools, parking, wristbands and check-in, or a second-class version of them.

Renters have declaration-level rights to the KPMA beach club and St. James pools but the rules phrase pool access as for 'renters through the Kingston Rental Program', the hotel/Splash pools are hotel property, guests cannot drive the owner's golf cart, and owners handle gate placards with no front desk.

Amenities for your guestsMost, not all
Off limits to your guestsEmbassy Suites Hotel pool and 'Splash' pools are hotel property; the rules list them as open to 'owners, guests, and renters through the Kingston Rental Program', so access for renters booked outside that program is unstated, Beach Club and St. James pool private-function reservations are for homeowners only ($150 deposit), Pets: renters and guests may not keep pets at all, Golf carts: the 2018 POA rules say operators must be a homeowner or an immediate family member, and owner-decal carts may not be rented, so renters may only use carts from KPMA-approved rental vendors (Rules 11; KPMA Rules Exhibit A Golf Carts 1c-d)
Wristbands & parking passesKPMA entrance pass system: everyone must register with Security at the Main Gate; owners receive an annual window decal; everyone else (guests/renters) must obtain an auto dash placard from Security and display it, or the vehicle may be removed. Cost of placards unstated; the KPMA Declaration lets the Declarant/KPMA run guarded gates and charge road tolls to commercial traffic or the public but says no Owner or Occupant (which includes a transient paying guest) shall be liable for any toll (KPMA Declaration 3.3, 1.1.17). Golf cart owner decals: one per unit, purchased annually, owner must be in good standing with KPMA; owner-decal carts may not be rented. Motorcycles, boats, personal watercraft, slingshots and mopeds may not be parked in Kingston Plantation; trailers/motorhomes only in designated KPMA areas at $25 per day/space (trailers max 7 days, motorhomes/campers max 24 hours, not to be occupied).
Check-inowner handles / unstated (no front desk or check-in service for West Hyde Park is described; guests self-register with gate Security)
TrashHousehold (kitchen) garbage only, securely tied in plastic bags and placed in the trash receptacles provided throughout KPMA and West Hyde Park property; contractors may not use Association dumpsters (Rules 21, 5g).
ElevatorsNot applicable: two-story buildings with exterior stairways (limited common elements); no elevator rules.

How much work lands on you?

Typical

What the rules make the owner personally responsible for: a local contact who answers in minutes, keys and passes, trash, fines for guest behaviour, vendor hours and elevators.

Registration of a rental agent, owner liability for all tenant damage and fines, owner-maintained decks/stairs, weekend contractor bans and hurricane-season furniture rules, but no response-time rule, trash hauling or key-control burden.

Local contactNot required as such; owner must register an 'approved rental agent' with KPMA and the POA (Rules 1). Each member must register a mailing address with the POA (Bylaws 3.04).
Locks & keysunstated (no lock, key or key-code rules; contractors must not prop doors open or admit unauthorized persons, Rules 5a). The POA has an irrevocable right of access to each unit during reasonable hours for maintenance or repair of common elements, emergency repairs, and extermination/pest control (Master Deed 5.5), so the owner must be able to provide entry.
FinesOwner is responsible for tenant damage to common property and for all fines levied on tenants (Rules 1). Repeated violations may draw a fine set by the Board case-by-case by severity, repeatable after notice, collected like regular assessments, with a right to a Board hearing (Rules 27). KPMA may also fine, suspend the subordinate association's voting rights, sue, and recover attorneys' fees from the violating party (KPMA Declaration 9.3); KPMA parking/golf-cart violations carry KPMA fines and decal revocation (KPMA Rules Exhibit A). Fireworks violators subject to prosecution, fines and eviction (Rules 12e, 14).
Contractors & vendorsContractor rules (Rules 5): no weekend or holiday work except emergencies; park only in designated area; keep common areas free of debris; no use of Association tools, dumpsters, utilities or common areas for cutting/painting; owner liable for damages or cleaning fees caused by their contractors. Exterior alterations require written approval of the POA Board (usually also KPMA Board); interior work touching common utilities, exterior or support walls requires prior Board approval via the Managing Agent (Rules 3-4). KPMA also bars weekend/holiday construction (KPMA Declaration 8.4.2).
AlsoOwner maintains (non-structural) the patio, deck, screened porch, storage area and exterior stairway appurtenant to the unit, and the branch pipes/wires serving the unit (Master Deed 2.3(b)(iv), (vi)); If the POA services the heating/air-conditioning equipment and lines serving a unit (Master Deed 2.3(b)(iii)), the cost is rebilled to that owner as an additional POA assessment (Master Deed 5.6). When absent for an extended period, deck/patio furniture and plants must be removed and stored inside, especially in hurricane season (Rules 2). Window treatments must show white to the exterior (Master Deed 5.1(k); Rules 22). Owner must furnish the POA a certified copy of the recorded deed on purchase (Bylaws 3.05). Owner 'ultimately responsible and accountable for any and all actions of their guests' (Rules 27). Quiet hours 11:00 PM to 8:00 AM (Rules 19). No grilling of any kind anywhere in Kingston Plantation (Rules 13; Master Deed 5.1(l)).

The fines may be assessed repeatedly upon failure of a resident to correct the infraction after prior notice is given by the Managing Agent. Is the money healthy?

Whether the association can pay for the building without surprise bills: reserves, special assessments, insurance deductibles, how fast dues are rising, and how much of the fee passes through to a master association.

Reserves are strong (17% of budget in 2024, 19% in the 2026 budget column, $1.2M balance) with no special assessments and negligible delinquency, and assessments were held at $1,078,099 from 2024 through 2026 after an 18.6% jump driven by a 71% insurance increase; offset by two opaque 29% lines (insurance, since cut to $244,000, and the KPMA pass-through) and no current adopted budget or reserve study.

The Feb 2026 operating statement's Annual Budget column shows insurance at $244,000 (22.6% of the $1,078,099 assessment level), with prepaid insurance of $161,720.25 on the balance sheet. Master Deed 6.2 requires a master casualty policy at 100% replacement value of units, common and limited common elements, $1,000,000 liability, insurer rated no less than Best's A+10, annual review with appraisal. KPMA separately insures its Common Areas as a KPMA common expense.

Who holds the power the documents hand out: an owner-elected board, or a developer or commercial-unit owner with deed-level rights over rentals, guest services and the building's name.

The POA has an owner-elected five-member board, no commercial unit and ordinary two-thirds amendment rules, but it is subordinate to a master association whose hotel-owner Declarant may appoint all KPMA directors while holding a Controlling Interest and is exempt from KPMA rules.

StructureTwo tiers: a master association above this one
Master associationKingston Plantation Master Association

BoardFive directors elected by secret ballot at the annual meeting (a Saturday in May), staggered two-year terms; directors must be POA members or representatives of entity members; removable by more than 50% of total votes at a special meeting (Bylaws 4.02, 4.07). Declarant's right to appoint directors lasted only until 75% of units were conveyed (Bylaws 4.02) and its amendment rights expired December 31, 1994 (Master Deed 9.1); no declarant control of the POA remains.
Developer rightsPOA level: expired (Phase election deadlines 1992-1996, unilateral amendment right to 12/31/1994, consent right only while Declarant owned a unit). KPMA level: the Declarant (hotel owner, FelCor Myrtle Kingston Hotel, L.L.C. / Kingston Resort Owner LLC) keeps rights as long as it holds a 'Controlling Interest' (10% or more of the total area of the 144.48-acre Property): the right to appoint all KPMA directors (KPMA Declaration 4.2.2), exemption from Article VIII architectural/use restrictions (8.2), a declared exemption from the KPMA rules (KPMA Rules Exhibit A), perpetual easements and sales/construction rights, and veto over termination (9.4). Whether the Controlling Interest still exists is unstated: the hotel parcel is described as 15.59 oceanfront acres, which is about 10.8% of the 144.48-acre Property (just over the 10% threshold), and the 2016 affidavit records that the Declarant voted as a Member and approved the restatement, which under Section 4.1 implies it then held a Controlling Interest. The 2018 POA rules describe the KPMA board as 'comprised of equal representation from each condominium'.
Commercial-unit rightsNo commercial unit or on-site rental operator inside West Hyde Park. At the KPMA level, no association may adopt any rule that 'prohibits limits or obstructs public access to the Common Areas or the commercial Parcels within the Development or any parking' (KPMA Declaration 2.3); the Declarant may allow public use of and charge fees for amenities it still owns; the KPMA board may lease or grant concessions over KPMA property (4.4). The Embassy Suites/Splash pools are hotel property, not KPMA Common Areas.
VotesPOA: each co-owner votes in proportion to the unit's percentage interest (Master Deed 2.7, 3.4); quorum is more than 50% of total votes; majority of votes present decides unless a greater vote is required (Bylaws 3.06, 3.08). KPMA: owners are not members; each subordinate association is a member and votes through its director/alternate (KPMA Declaration 4.1, 4.2.3); KPMA bylaws (Exhibit B) not in the set.
Changing the deedMaster Deed and Bylaws: two-thirds of all voting interests, no change to a unit's dimensions or percentage without that owner's consent (Master Deed 9.2). Major structural alteration of common elements: 75% of co-owners (8.2). Termination: unanimous co-owner vote plus all mortgagees (10.1). KPMA Declaration: two-thirds of total Member votes, with owner/mortgagee consent where materially and adversely affected (KPMA 9.1.2); Declarant may amend unilaterally for statutory/title/lender compliance (9.2).
Disputes or lawsuitsNone stated in the documents. Legal services budgeted at $3,000 (2024) and $2,000 (2026 budget column), with $0 spent YTD Feb 2026.

03 Pros and cons

For the owner who runs it themselves.

The same building reads very differently to an owner on the rental program and an owner on Airbnb. This list is for the second one.

Working for you

  • Short-term rental is permitted with no minimum stay, no owner-use cap and no requirement to use any on-site or hotel rental program; leases just need to be in writing and subject to the Master Deed and Bylaws (Master Deed 5.1(f)).
  • No commercial unit, no developer control and no rental-operator monopoly inside West Hyde Park: a five-member owner-elected board with staggered two-year terms runs the POA (Bylaws 4.02; Master Deed 9.1).
  • Reserves are healthy: $183,085 budgeted to reserves in 2024 (17% of the budget, rising to $210,087 in the 2026 budget column) and a reserve fund balance of $1,198,403.63 at 02/28/2026, with no special assessments stated (2024 Budget; Fund Balance Sheet 02/28/2026).
  • Delinquency is negligible: accounts receivable of $2,972.91 against roughly $89,840 billed per month, and the operating fund was running ahead of budget YTD Feb 2026 (Fund Balance Sheet and Operating Fund Income Statement, Feb 2026).
  • Dues bundle a lot: water/sewer, trash, pest and termite, building insurance, shared cable TV and internet via KPMA, gate security, roads, landscaping and the KPMA beach club and St. James pools (2024 Budget; Rules Definitions 1).
  • Renters have a declaration-level right to KPMA Common Areas as 'Occupants', a term that expressly includes a 'transient paying guest' (KPMA Declaration 1.1.17, 3.2), and the beach club and St. James pools are open to residents regardless of building (Rules 15a).
  • Fines require repeated violations after notice and the owner may demand a Board hearing; there is no published fine schedule, 30-minute response rule or service-elevator regime (Rules 27).
  • Owners' pets (dogs and cats) are allowed in the unit subject to leash/indemnity rules (Master Deed 5.1(i); Rules 20).
  • Annual CPA-audited financial statements are required by the Master Deed and an estoppel statement costs no more than $50 (Master Deed 4.11, 4.13).

Watch-outs

  • Owners who rent must give KPMA and the POA written notice naming an 'approved rental agent', and all rental agents must first comply with a KPMA 'Minimum Rental Agency Arrangements' policy that is not in this set; whether a self-managing owner with no agent satisfies this rule is unstated (Rules 1).
  • The pool rule describes amenities as open to 'owners, guests, and renters through the Kingston Rental Program'; the Embassy Suites and Splash pools are hotel property, so access for guests booked through Airbnb/VRBO or an off-site manager is not guaranteed by any document here (Rules 15a).
  • Every guest must register with gate Security and display a dash placard; owners handle this (no front desk), and motorcycles, boats, jet skis, mopeds and slingshots cannot be parked on the property at all, which can affect bookings (Rules 10; KPMA Rules Exhibit A).
  • Renters and guests may not bring pets under any circumstances, and grilling of any kind is banned everywhere (Master Deed 5.1(i), 5.1(l); Rules 13, 20).
  • Dues jumped 18.57% from 2023 to 2024 (total budget $909,234 to $1,078,099), driven by a 71.43% insurance increase ($181,600 to $311,322, now 29% of the budget) and a 25.47% rise in the KPMA pass-through ($248,135 to $311,342, also 29%); the master pass-through is a single opaque line and the KPMA budget is not in the set (2024 Budget).
  • The only adopted budget on file is 2024; the Feb 2026 statement shows assessments held at $1,078,099 with insurance budgeted at $244,000 and KPMA at $324,703, but no 2025 or 2026 adopted budget, reserve study or insurance policy was provided (Operating Fund Income Statement, Feb 2026).
  • The POA Board may levy a special assessment of up to 10% of the prior year's budget without any owner vote, owners are liable by percentage interest for any insurance deductible or shortfall after a casualty, and the KPMA board can separately levy a per-unit special assessment for its own deductible or unexpected Common Area repairs on a board vote alone (Master Deed 4.7, 7.4; KPMA Declaration 5.7, 7.1.1).
  • The KPMA Declarant (the hotel owner) keeps the right to appoint all KPMA directors while it holds a 'Controlling Interest' (10% or more of the 144-acre Property), is exempt from the KPMA rules and architectural restrictions, and no sub-association may restrict public access to Common Areas, commercial parcels or parking; the KPMA bylaws are missing so actual board composition cannot be verified (KPMA Declaration 1.1.9, 2.3, 4.2.2, 8.2; KPMA Rules Exhibit A).
  • Owners are financially responsible for all tenant damage and all fines levied on tenants, fines are set case-by-case with no published schedule and can repeat, and KPMA can also fine, suspend the association's vote and recover attorneys' fees (Rules 1, 27; KPMA Declaration 9.3).
  • Owners maintain their own patio/deck/screened porch, storage area and exterior stairway (non-structural) and the branch pipes and wires serving the unit, and must clear deck furniture when away in hurricane season (Master Deed 2.3(b)(iv), (vi); Rules 2).
  • Contractors may not work on weekends or holidays, must park in a designated area and cannot use Association dumpsters or utilities, which slows turnover repairs (Rules 5).
  • The current unit count and per-unit dues cannot be determined from this set: the Master Deed submits only Phase I (29 units) and reserves up to 19 more phases, and neither the budget nor the statement states a per-unit assessment (Master Deed 2.2, 2.8, Exhibit F).
  • The 2018 rules skip rule numbers 6-9 and 18 and one of the 18 recorded pages is unaccounted for, although the page footers run consecutively, so a few rules may exist that this set does not show (Rules, transmittal '1 OF 18'; page footers 2-16).
  • Guests cannot use the owner's golf cart: the 2018 POA rules limit golf cart operators to a homeowner or immediate family member and the KPMA rules bar renting out owner-decal carts, leaving only KPMA-approved cart vendors for renters (Rules 11; KPMA Rules Exhibit A Golf Carts 1c-d).

What you pay, and where it goes.

An HOA fee is a share of a budget. The budget tells you whether the fee is buying upkeep or catching up on it.

What to put in the house manual.

Golf carts: SC-registered, KPMA decal (one owner decal per unit, annual purchase, insurance on file, owner in good standing), drivers 16+ and licensed under the KPMA rules (2018 POA rules say 15+ or permit), and the 2018 POA rules say golf cart operators 'must be a homeowner or an immediate member of the family', which on its face excludes renters; paved roads only, park in designated secondary spaces, charging only in garages/carports/approved stations, owner-decal carts may not be rented, only KPMA-approved vendors may rent carts. 06 Before you write an offer

What to ask the association for.

The documents we had leave these open. Ask for them in the due-diligence period and the score firms up.

Documents read October 2026. Full read: Deed, rules and the money were all on file.

Read this before relying on anything aboveEvery statement on these pages is read from the association's own recorded documents, named on the page, as they stood on the date shown. Boards amend rules, budgets change every year, and a recorded amendment can change a score overnight. Confirm anything you would rely on with the association or your closing attorney before you write an offer. This is not legal, tax or investment advice.
