02 The five questions

What the documents decide
before your first guest books.

Five dots is the best answer for an owner who wants to run the unit themselves. One dot is a red flag. Open “What the documents say” under each for the exact words.

01

Can you rent it your way?

Caution

Whether the deed and rules let you rent short-term on your own terms: no requirement to use the on-site program, no minimum stay that kills weekend bookings, and no rule against saying where the condo is.

STR is capped at 12 apartments association-wide, awarded by lottery for 2-year slots with a 7-night minimum and prior Board approval, so a buyer of Unit 101 has no assured right to short-term rent; the offsets are that 30+ day leases are unlimited and, once a slot is held, self-management or any agency is allowed.

Short-term rentalsAllowed with limits
Minimum stay7 nights
Must use on-site programNo
Owner may rent it personallyYes
Off-site manager allowedYes
RegistrationBefore any short-term rental the Co-Owner must apply for and receive written Board approval; STR is limited to 12 apartments, allocated by lottery ('luck of the draw') for 2-year slots (Oct 1 - Sep 30) with applications due March 15 and selection by April 1; the slot holder must provide a City of Myrtle Beach Short-Term Business license or a signed Agency Contract within 30 days or the slot passes to the next name drawn. Copies of ALL short- and long-term leases must be deposited with the Association (master copy of the rental contract on file with the office; owners may file each rental contract electronically, and MUST do so for every rental through the end of the next calendar year after 2 renter-related violations in a year). All owners, guests and renters must register with the lobby office upon arrival or the next business day, and tenants/guests must check in with the Board and/or managing agent before commencing their stay.
Advertising rulesNo resort-name, photo or disclaimer rules. Advertising a unit for short-term rental without an approved slot is itself a violation: 24 hours to remove the listing or change it to a 30-day minimum; after 10 days $1,000 and $1,500 each subsequent week.
Vote to change rental rulesBy-Laws (including the leasing section) are amended by Co-Owners representing at least two-thirds (66 2/3%) of the total basic value of the Property (By-Laws Art. XIV, per Third Amendment recital). The fine schedule and the STR selection process each state 'To change this policy requires a majority membership vote.' Master Deed amendment threshold is unstated (Atlantis Master Deed not in set).

02

Will your guests be treated like guests?

Typical

Whether a guest who booked through you gets the same resort as a guest who booked through the front desk: the same pools, parking, wristbands and check-in, or a second-class version of them.

Owners, guests and renters share every amenity with no program tier and a lobby office registers arrivals and issues parking passes, but there is no 24-hour front desk, summer deck parking is one car per unit, guests may not bring pets, and keys/locks are unstated.

Amenities for your guestsSame as program guests
Off limits to your guestsPets: owners may keep one registered pet; guests/renters may not bring any pet ($125/day), Bicycle Storage Room is for Owners as space permits
Wristbands & parking passesNo wristbands. Every vehicle needs a valid Atlantis parking pass from the lobby office or a decal. North lot/parking deck limited to one (1) vehicle per unit May through August and two after summer; additional registered vehicles use the overflow South Lot (chain-gated, re-chain on exit). No back-in parking, golf carts, mopeds or vehicles over roughly 3/4 ton (OCR unclear); trailers only with advance office approval and permit in the rear of the South Lot; no RVs; violators towed at owner's expense.
Check-inLobby office handles registration: all owners, guests and renters must register with the office in the lobby upon arrival or the next business day; the Third Amendment also requires tenants/guests to check in with the Board and/or managing agent before commencing. No 24-hour front desk is described. Keys/locks: unstated.
TrashOccupants bag trash and carry it to the dumpster next to the Breakers parking garage; trash left elsewhere $75; household trash only; construction materials go to the Breakers dumpster across from the South entrance; improper items may draw a $250 Breakers charge passed through to the violator.
ElevatorsNo service-elevator or vendor restriction stated. Elevators not to be used in fire (return to first floor for fire department). Children may not play in elevators or hallways. Luggage carts in the basement, 30-minute limit, must be returned.
Housekeeping & linenunstated (no on-site housekeeping or linen service described; dues cover monthly in-unit pest control on the first Tuesday). Laundry/vending income line suggests common laundry machines.
What the documents say (5)

“We have a limited number of parking spaces and each vehicle occupying a space must have a valid Atlantis parking pass from the office or valid decal. The North parking lot is restricted to one (1) vehicle per unit on parking deck from May through August and two cars per unit after the summer months. 03

How much work lands on you?

Typical

What the rules make the owner personally responsible for: a local contact who answers in minutes, keys and passes, trash, fines for guest behaviour, vendor hours and elevators.

Beyond normal hosting the owner must win and renew a lottery slot, hold a City STR license, obtain Board approval, deposit every lease, ensure guest registration, warn guests about monthly pest control, clear the balcony between stays, and absorb steep leasing fines plus costs.

FinesRecorded fine schedule: Class I $75 (smoking in common areas, parking, glass in pool area, improper trash, littering, failure to submit current insurance certificate within 10 days of request, failure to provide pest-control receipt before declining service); Class II $125 (balcony violations incl. failure to clear before a Warning, unauthorized/loud animals per day, disturbing the peace, missing or inoperable kitchen/bath fans); Class III $250 (compromising security, damage to common areas, underage tenants with right to evict, damaging pool rope/equipment). Leasing violations: exceeding maximum occupancy $250 per night regardless of age; violating the 7-day minimum $500 first offense then $1,000 each (calendar-year basis); unauthorized short-term rentals $1,000 then $1,500 each; advertising an unauthorized STR $1,000 after 10 days then $1,500 per week; unlisted violations $50. Every fine is the base amount plus any costs incurred. Fines for renter conduct fall on the Co-Owner (Third Amendment Sec. 18.G: immediate notice of default and fine or sanction in the Board's sole discretion), and offending tenants are subject to immediate eviction. Changing the fine policy requires a majority membership vote.
Contractors & vendorsunstated (no contractor hours, service-elevator or insurance-certificate rules for vendors). Construction materials may not go in the Atlantis dumpster; they go to the Breakers dumpster across from the South entrance. Luggage carts limited to 30 minutes.
AlsoOwner must (a) win and later re-win a 2-year STR lottery slot, (b) obtain a City of Myrtle Beach Short-Term Business license or sign an agency contract within 30 days, (c) obtain written Board approval, (d) deposit copies of every lease with the Association and keep a master rental contract on file, (e) see that guests register at the lobby office and check in with the Board/managing agent, (f) advise guests of mandatory in-unit pest control the first Tuesday of each month, (g) keep kitchen and bath exhaust fans operable and have guests use them, (h) clear the balcony of all items whenever the unit is unoccupied and at any hurricane Watch, (i) furnish a current insurance certificate within 10 days of request, (j) ensure no guest pets, and (k) after 2 renter-related violations in a year file every rental contract electronically through the end of the following year.

Is the money healthy?

Whether the association can pay for the building without surprise bills: reserves, special assessments, insurance deductibles, how fast dues are rising, and how much of the fee passes through to a master association.

Reserves are funded at 17.7% of a $699k budget, dues rose 4.84% and insurance only 4.06%, with cable, pest control and trash included; the drag is insurance at 43.6% of budget on a 1979 building and the absence of reserve balance, financials and assessment history.

Dues change+4.8% on the year
Reserves18% of budget

Special assessmentsNone in the documents
InsuranceInsurance Expense $293,039 (2024) to $304,923 (2025), +4.06%; it is the single largest line and 43.6% of the total budget. Carrier, coverage, named-storm/wind and flood deductibles are not in the set. The fine schedule requires owners to produce a current insurance certificate within 10 days of request, implying owners must carry their own unit (HO-6) policy.

Who's really in charge?

Favorable

Who holds the power the documents hand out: an owner-elected board, or a developer or commercial-unit owner with deed-level rights over rentals, guest services and the building's name.

An owner-elected board, no developer or commercial-unit rights in the Atlantis documents, and membership-majority control over fine and STR policy are strong; but the Atlantis Master Deed and By-Laws are missing, board size/terms are unverified, and leasing fines rest in the Board's sole discretion.

StructureOne association
BoardBoard is elected by a majority of Co-owners at the annual meeting, held the second Saturday of November at 10:00 AM (1981 By-Laws amendment). Board size, terms and officer structure are in the Atlantis By-Laws, which are not in the set; the 2021 amendment is signed by a President, Vice-President, Secretary and Treasurer.
Developer rightsOriginal grantor was Singleton Swash, Inc., a Florida corporation (Master Deed dated 12/22/1978). The 1981 amendment tied the first annual meeting to sell-out or the Grantor's election to end control; owners have since adopted amendments in 1981 and 2021 by two-thirds vote, so developer control is historical. No surviving developer rights are referenced.
Commercial-unit rightsunstated. No commercial unit, on-site rental operator, front-desk monopoly or amenity-ownership rights appear in any Atlantis document; the Atlantis Master Deed that would define them is not in the set.
VotesVotes are weighted by each apartment's percentage interest in the total basic value of the property per Exhibit F to the Master Deed (Exhibit F not in set). By-Laws amendments: at least two-thirds (66 2/3%) of total basic value. Fine schedule and STR selection policy: majority membership vote. Board elections: majority of Co-owners at the annual meeting.
Changing the deedBy-Laws: two-thirds (2/3) of total basic value, recorded with an officers' certificate (Art. XIV per Third Amendment recital). Master Deed: unstated.
What the documents say (4)
“Thereafter, the Association shall hold the annual meeting on the second Saturday of November of each year thereafter, at 10 o'clock A.M. unless the date falls on a legal holiday and then it will be held on the following working day. In said meeting a majority of Co-owners as herein defined, shall elect the Board of Directors for the Association.”Amendment to By Laws (1981), Article II, Section 2 (Annual Meeting), as amended; Deed Book 716
“WHEREAS, Singleton Swash, Inc., a Florida Corporation recorded a certain Master Deed Establishing Atlantis Horizontal Property Regime and all exhibits thereto and incorporated therein by reference (hereinafter "Master Deed"), dated December 22, 1978, at the Office of the Register of Deeds for Horry County, South Carolina on March 22, 1979 in Deed Book 637 at Page 479”Third Amendment to ByLaws, Recitals, page 1 of 6
“WHEREAS, Article XIV of the Bylaws provides for Amendments and states the By-Laws may be amended by Co-Owners representing at least two-thirds (2/3) of the total basic value of the Property, as set forth in Exhibit "F" attached to the Master Deed”Third Amendment to ByLaws, Recitals, page 1 of 6
“To change this policy requires a majority membership vote. ADOPTED by a Majority of the Association Membership this thirteenth day of November, 2021.”Resolution of Process 2021, Selection Process resolution (Deed Book 4502 Page 1410)
03 Pros and cons

For the owner who runs it themselves.

The same building reads very differently to an owner on the rental program and an owner on Airbnb. This list is for the second one.

Working for you

  • If you hold an STR slot you may self-manage with your own City of Myrtle Beach Short-Term Business license or use any rental agency of your choice; there is no on-site program to join (Resolution of Process 2021, Selection Process, Deed Book 4502 Page 1410).
  • Rentals of 30 consecutive days or more are unlimited in number and need no slot, so a monthly/seasonal strategy is always open (Third Amendment to ByLaws, Art. XI Sec. 18.B).
  • Owners, guests and renters share every amenity under one rulebook; there is no rental-program tier, wristband scheme or amenity reserved to program guests (RULES AND REGS, Occupancy and Pool).
  • A lobby office registers all arrivals and issues parking passes, so the owner does not have to meet every guest in person (RULES AND REGS, Occupancy and Parking).
  • Reserve funding of $123,459 is 17.7% of the 2025 budget and a reserve study is budgeted as its own line (2025 Budget, General & Administrative and notes).
  • Dues rose 4.84% for 2025 and the insurance line rose only 4.06%, well under the double-digit jumps common on the Grand Strand (2025 Budget, Income and Insurance).
  • Dues include cable TV, monthly in-unit pest control, trash and building insurance (2025 Budget, Utilities; RULES AND REGS, Pest Control).
  • The Board is elected annually by a majority of owners and owners themselves have amended the By-Laws by two-thirds vote in 1981 and 2021; no developer or commercial-unit rights appear in the Atlantis documents (Amendment to By Laws 1981, Art. II Sec. 2; Third Amendment to ByLaws, recitals).
  • The fine schedule and the STR selection rules can only be changed by a majority vote of the membership, not by the Board alone (Resolution of Process 2021, both resolutions).
  • No special assessments are referenced in any document in the set (2025 Budget; all documents).

Watch-outs

  • Short-term rental is capped at 12 apartments association-wide and allocated by lottery for 2-year slots; buying Unit 101 gives no right to short-term rent until you win a slot, and a slot must be re-won (Third Amendment to ByLaws, Art. XI Sec. 18.A; Resolution of Process 2021, Selection Process).
  • Hard 7-night minimum on all short-term rentals; violations cost $500 then $1,000 each, unauthorized STR $1,000 then $1,500 each, and merely advertising without a slot draws $1,000 after 10 days plus $1,500 per week (Third Amendment Sec. 18.A; Resolution of Process 2021, Leasing Violations; RULES AND REGS, Occupancy).
  • Written Board approval is required before any STR, the Board may add further STR rules at will, and leasing-violation sanctions are set 'in their sole discretion' (Third Amendment to ByLaws, Art. XI Sec. 18.A.1, 18.A.2, 18.G).
  • You must hold a City of Myrtle Beach Short-Term Business license or a signed agency contract within 30 days of being drawn or the slot passes to the next owner (Resolution of Process 2021, Selection Process).
  • Insurance is $304,923, 43.6% of the entire budget, on a building whose master deed dates to 1979; deductibles, wind and flood terms are not in the set (2025 Budget, Insurance; Third Amendment recitals).
  • The 'Master deed and By Laws.pdf' in this folder is for Ocean Reef Resort North Tower, not Atlantis; the Atlantis Master Deed (Deed Book 637 Page 479) and By-Laws are missing, so percentage interests, unit count, deed-level rental rights and master-deed amendment rules are unverified (Master deed and By Laws.pdf, cover page).
  • Guests and renters may not bring pets ($125 per day) and occupancy caps are enforced at $250 per night, both of which shrink the bookable market and raise the owner's fine exposure (RULES AND REGS, Occupancy; Resolution of Process 2021, Leasing Violations).
  • Summer parking is one vehicle per unit on the deck from May through August with overflow in a chain-gated lot; no golf carts, trailers without approval, or RVs (RULES AND REGS, Parking).
  • After two renter-related violations in a calendar year the owner must file every rental contract electronically through the end of the following year (Resolution of Process 2021, Policy update).
  • Mandatory in-unit pest control on the first Tuesday of every month; the owner must warn guests and proof of an alternate provider is required to decline, else $75 (RULES AND REGS, Pest Control).
  • Owner must clear the balcony whenever the unit is unoccupied and at any hurricane Watch, a hard task for a remote STR owner between guests ($125 at Warning) (RULES AND REGS, Balconies).
  • Trash removal is budgeted up 45.75% and cable TV up 11.41% for 2025; reserve balance, financial statements and special-assessment history are not in the set (2025 Budget, Utilities).

06 Before you write an offer

What to ask the association for.

The documents we had leave these open. Ask for them in the due-diligence period and the score firms up.

Documents read October 2026. Full read: Deed, rules and the money were all on file.

Read this before relying on anything aboveEvery statement on these pages is read from the association's own recorded documents, named on the page, as they stood on the date shown. Boards amend rules, budgets change every year, and a recorded amendment can change a score overnight. Confirm anything you would rely on with the association or your closing attorney before you write an offer. This is not legal, tax or investment advice.
The next step

Have the documents read
for the building you are weighing.

This page says what the association's documents allow, require and cost. It cannot tell you which unit is listed this week, or what the seller's estoppel will say. Tell us the resort and we will read its documents against this framework, or pull them if you are under contract.

We use the numbers on this page to answer you specifically. No list, no drip sequence — a person reads it.
